Overview

Many of us will unfortunately be faced at some point in our lives having to make decisions for loved ones that we do not want to make. Some of these decisions will be made for us -- we will have no choice and no control over them. When it becomes impossible to care for a loved one because of a disability, the last alternative we have is often a nursing home. For most of us, that is indeed the last resort.

How to Pay for a Nursing Home

There are 4 ways to pay for nursing home care:

  1. Out of the disabled person's (or spouse's) pocket; or

  2. From a long term care insurance policy; or

  3. Out of the pockets of the children of the disabled person; or

  4. From governmental assistance.

How to Qualify for Governmental Assistance

Because many people cannot afford expensive skilled nursing care and because many people do not have long term care insurance, most people must look elsewhere for help. Medicaid is a federal assistance program for persons needing skilled nursing care who are disabled and who meet certain "means" tests. In Florida, this is called the Institutional Care Program (ICP) and this program, although federal in origin, is administered by the State of Florida.

Because this is a means tested program, applicants must meet certain threshold criteria before they will be deemed qualified to receive benefits from Medicaid. While there are a number of "tests" to meet, they can be divided into 3 segments:

  1. Medically Needy Test

  2. Income Test

  3. Asset Test

What we do is to help clients navigate their way through the requirements and thresholds of each of these 3 tests. Once we have determined a client can qualify, then we will assist the client in applying and being their designated representative throughout the Medicaid application and qualification process.

Our Medicaid/Nursing Home Protector Program™ is structured so as to permit clients to take charge of their own destiny by protecting all of their assets for their spouses and children -- without having to spend their assets on care for devastating illnesses.

Advantages of our Program

We take pride in being able to achieve predictable results for our clients. Provided we receive full and complete information from our client, and provided the client has not previously done those things that would disqualify them from immediate qualification, we are able to design a plan for our clients that usually protects most of their assets from seizure by the nursing home or any type of forced spend-down of their existing estate.

Our plan designs for our clients can provide them with sheltering most of their principal and protection for a spouse and children.

In addition, we can design a plan that provides for supplemental needs Medicaid does not pay for such as medications, non-necessary medical care & procedures, hair & nail & other personal care needs, special dietary supplements, entertainment, electronic equipment (such as telephone, television, cable, internet, satellite & wireless services), Care Managers (including Guardian services and Companion services), visitation and vacation-related expenses, special equipment and clothing, supplemental nursing care, rehabilitative & physical therapy, mobility aiding equipment, medical implants, artificial limbs, and psychological services.

Medicaid/Nursing Home Protector Program™

Our protection program is divided into 2 phases:

  1. Pre-Planning Protector™

  2. Crisis Planning Protector™

In our Pre-Planning program, we help clients begin to structure their affairs well in advance of the need of skilled nursing care. This involves analyzing health issues, cataloging assets and reviewing financial histories to determine any potential future problem areas in a possible Medicaid application. In addition, we prepare our comprehensive Protector Pathway report that maps out a pathway to follow so as to be able to protect your assets regardless of what may happen in the future.

Crisis Planning involves moving very quickly to adjust the client's financial framework so as to qualify for benefits in relatively short order. Although we may be able to help the client qualify, because of the shortened time frame, not every option is available to us that would have been available had we been given sufficient opportunity to adequately pre-plan and to employ our Protector Pathway program.

Planning 231: Annuities and Medicaid Planning is a continuing education workshop for professional advisors that begins their training to become an Oxford Wealth Certified Elder Consultant (OWCEC). Oxford Wealth certifications bear a mark of distinction not afforded other advisors. Oxford Wealth certifications are difficult to obtain and expensive. Our law firm is a member of The Oxford Wealth Companies and we provide faculty for the various Oxford Wealth certification programs through The Oxford Wealth Education Forum, Inc., a not-for-profit educational forum.
